Terms of Use
Please read these Terms of Use carefully. They are a legally binding agreement between you and the operator of RangeBites. RangeBites is a food-information website. It does not track you. If you do not agree, do not use the Service.
1. Acceptance of terms
These Terms of Use (the “Terms”) govern access to and use of the website located at rangebites.com and related pages (the “Service”). The Service does not require payment. You agree to these Terms by tapping Continue on first use, and by continuing to use the Service. That agreement is formed with each person who uses the Service. If you do not agree, you must discontinue use immediately.
2. Operator; website developer
The Service is designed, published, and operated by an individual website developer (the “Operator”), not by a restaurant, franchise, or food-service company. The Operator is one person. RangeBites is not a limited liability company. The Operator provides an information website only. The Operator is not a food provider, driver, insurer, attorney, or agent of any restaurant. Nothing on the Service creates a professional, fiduciary, or employment relationship with the Operator.
3. Nature of the service
RangeBites is a food-information website. It displays nearby restaurant and related food listings so you may open third-party maps or merchant sites. It is not a reservation system, delivery service, payment processor, coupon issuer, or marketplace. It is not legal, tax, medical, or financial advice. It is not RangeBits and is not a finance or trading product. No account is required. The Operator does not operate a consumer email list.
Any “deal” or promo text appears only if the underlying listing already contains such a tag from its source. The Specials page is optional restaurant contact for review. It is not a live coupon, a promise of price, or a diner mailing list.
4. Third-party data; no invention
Listings, hours, addresses, and related tags are obtained from OpenStreetMap and similar public sources. Such data may be inaccurate, incomplete, or out of date. The Operator does not invent hours, star ratings, coupons, or pantry locations. The Operator does not inspect kitchens, verify hours, honor promotions, take reservations, or process payments. You are solely responsible for confirming information with the restaurant or venue before you travel or purchase.
5. Maps and third-party sites
Directions may open Apple Maps or Google Maps. A Reviews control opens Google Maps search for that place. RangeBites does not scrape Google, does not display Google star ratings, and does not use Google marks. Those map services are independent. Their terms and privacy policies govern your use of them. The Operator has no control over, and assumes no responsibility for, those services or for any trip, purchase, or meal that follows.
6. Eligibility
You must be at least thirteen (13) years of age to use the Service. The Service is not directed to children under 13.
7. License and acceptable use
The Operator grants you a limited, revocable, non-exclusive, non-transferable license to access the Service for your personal, lawful, informational use. You shall not scrape, overload, reverse engineer, or disrupt the Service; submit false information; attempt unauthorized access; or present RangeBites as RangeBits or as a finance product. The Operator may suspend or terminate access for conduct reasonably believed to violate these Terms.
8. Intellectual property
Original text, layout, and selection on the Service are owned by the Operator. Map data and place tags remain the property of their sources, including OpenStreetMap contributors, and are used subject to the Open Database License (ODbL). See openstreetmap.org/copyright. “RangeBites” is the name of this website. The Operator does not claim a registered trademark in that name. Domain registration is not a trademark. You may not copy the Service to build a competing product.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE OPERATOR DOES NOT WARRANT THAT LISTINGS, HOURS, MAPS, DEALS, OR THE SERVICE WILL BE ACCURATE, COMPLETE, CURRENT, OR UNINTERRUPTED. FOOD, TRAVEL, AND PURCHASING DECISIONS ARE YOURS ALONE. THE SERVICE IS NOT A SAFETY, NAVIGATION, OR EMERGENCY SERVICE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR AND THE WEBSITE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR RELIANCE ON ANY LISTING, HOUR, DEAL, MAP, OR THIRD-PARTY SITE, INCLUDING WITHOUT LIMITATION A CLOSED RESTAURANT, STALE HOURS, AN INCORRECT LOCATION, FOOD YOU CONSUME, OR TRAVEL YOU UNDERTAKE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and the website developer from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your reliance on listings, or your violation of these Terms.
12. Privacy
Location, if you choose to share it, is used for the current search only and is not stored as a location history. The Privacy Policy describes what the host may see in order to fetch map data. The Privacy Policy is incorporated by reference.
13. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Virginia, United States of America, without regard to conflict-of-laws rules. Subject to applicable law, exclusive venue for any court action arising out of these Terms or the Service shall lie in the state or federal courts located in Virginia, and you consent to personal jurisdiction there.
14. Changes
The Operator may revise these Terms at any time by posting an updated version with a new effective date. Continued use of the Service after an update constitutes acceptance of the revised Terms.
15. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions shall continue in full force. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and the Operator concerning the Service and supersede prior understandings on that subject. Headings are for convenience only. “Including” means “including without limitation.”
16. Contact
The Service is operated at rangebites.com. Restaurant operators may use the Specials page for optional review contact. The Operator does not collect diner emails and does not publish a consumer support inbox on the Service.
